NHS Professionals Statutory and Mandatory Training programme

The Skills for Health UK Core Skills Training Framework (CSTF) sets out 10 statutory and mandatory training topics for all staff working in healthcare and social care settings. The CSTF includes nationally agreed learning outcomes and training delivery standards.

Health Education England e-Learning for Healthcare (HEE e-LfH) has worked with a range of subject matter experts to develop high quality, national e-learning training sessions, which address all the knowledge outcomes at level 1 and 2 and at level 3, where appropriate for e-learning.

The sessions are freely available to all health and social care staff.

It is the responsibility of individual health and social care employer organisations to ensure that their workforce complete the appropriate training to comply with their statutory and mandatory requirements. Statutory and mandatory training represents a significant investment and undertaking for all staff working within NHS South Central, often on an annual basis. At the same time, Trusts within the Region have requested a pragmatic approach to accepting the training record of staff as they move within NHS South Central. The Statutory and Mandatory Training Framework was first published in May 2010 for use as a standardised assessment tool across NHS South Central. What is statutory training?

Statutory training is the training that is usually required by law or where an organisation has been instructed by a statutory body to provide such training on the basis of specific legislation. There is therefore a legal responsibility on every employer to ensure their all their staff have the knowledge to maintain a healthy and safe working environment for themselves and their colleagues, and their clients.

The Health and Safety at Work Act 1974 and the Management of Health and Safety at Work Regulations 1999 are the basis for statutory training across the UK. Employers may often describe statutory training as ‘essential’ or ‘compulsory’ training. In most cases, statutory training can be used to describe both mandatory training and statutory and statutory training. Some organisations may refer to statutory training as 'statutory mandatory training', 'statutory and mandatory training' or simply 'mandatory training'.

In the NHS and many other healthcare employers, all new healthcare workers (doctors, nurses, allied health professionals and healthcare assistants) are required to undertake core mandatory health and safety awareness courses and training. What statutory training is required to start a new healthcare or social care job?

All new doctors, nurses, allied health workers (ahps) and healthcare assistants (hcas) are required to attend a mandatory induction training when they start a new job within the first 2-4 weeks. All the statutory training courses and mandatory training courses should be completed by all candidates within the first year of starting a new job in a hospital or healthcare environment. Usually all the mandatory and statutory training courses are completed within the mandatory induction training for medical, nursing and care staff. All healthcare and social care organisations consider mandatory and statutory training as compulsory under the terms and conditions of employment in the sector. 

What is mandatory training?

Mandatory training refers to the compulsory training that is determined essential by a healthcare of social care organisation for the safe and efficient delivery of its services. The Mandatory Training Group's mandatory training is designed to reduce organisational risks and to comply with local or national policies, regulatory requirements and government guidelines. Many health and social care organisations interchangeably use the terms 'essential training' or 'compulsory training' to cover both 'mandatory and statutory training'. 

So what is the difference between statutory training and mandatory training?

To make the distinction between 'mandatory training' and 'statutory training', the NHS uses the following definition "Mandatory training is an organisational requirement to limit risk and maintain safe working practice. You must attend a Trust induction in your first month of starting work at the Trust. During your first year you must also complete the statutory and mandatory training sessions that were not covered in your induction"

Which Training Courses are Mandatory in Social Care?

At The Mandatory Training Group, we get many enquiries from health and social care organisations and individuals alike wanting to know about which mandatory courses would be suitable for them. In fact, there seems to be a lot of confusion regarding which  mandatory courses are suitable for social care staff. The Mandatory Training Group have put together a number of mandatory training packages for health and social care organisations. These training modules are designed to meet the Care Quality Commission (CQC) requirements for social care mandatory training as well as Skills for Care's recommendations for care staff training. 

To clarify this issue once and for all, “There is no single mandatory training list that applies universally to every social care provider.” 

So what constitutes mandatory training for social care?

Training for care staff is defined as mandatory if it meets any one or more of the following criteria:
* If the training is a statutory requirement, for example 'Health and Safety' training is a statutory requirement under the Health and Safety at Work Act 1974
* All staff across the organisation require the training in order to safely and effectively carry out their work, for example First Aid and Cardiopulmonary Resuscitation (CPR) training
* If the training is a Care Quality Commission (CQC) or local authority requirement. 

Health and Social Care Act 2008 (Regulated Activities) Regulations 2014: Regulation 18 (CQC Regulation 18)

The intention of this regulation is to make sure that providers deploy enough suitably qualified, competent and experienced staff to enable them to meet all other regulatory requirements described in this part of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014. To meet the regulation, providers must provide sufficient numbers of suitably qualified, competent, skilled and experienced staff to meet the needs of the people using the service at all times and the other regulatory requirements set out in this part of the above regulations. Staff must receive the support, training, professional development, supervision and appraisals that are necessary for them to carry out their role and responsibilities. They should be supported to obtain further qualifications and provide evidence, where required, to the appropriate regulator to show that they meet the professional standards needed to continue to practise.

Most of the available guidance provided is for social care providers in England. Social care providers in other UK countries should seek for further guidance from relevant regulators in the host countries. 

Mandatory training is the compulsory training that social care providers are expected to provide to their staff following statutory requirements such as the Health and Safety at Work Act, requirements of your local authority, and the requirements specified by the CQC. All health and social care organisations have a legal responsibility to provide staff with Health & Safety awareness training, including, Fire Safety.  Moving and Handling training is also mandatory and if staff are involved with preparing food or assisting at meal times then Food Safety and Hygiene training will also be mandatory.

There is a difference between the courses that would be considered mandatory for your organisation and the courses you will need to provide in order to be able to issue a Care Certificate. To receive a Care Certificate, your staff member will need to train in and achieve minimum pass marks in ALL the 15 standards. For experienced care staff, this will mean updating their knowledge and experience with the new terminology and practices as appropriate. Any new recruits, who have never worked in social care before, will need to be trained in all 15 standards before you can award them a Care Certificate.

When should healthcare professionals attend mandatory training?

Organisations such as the Royal College of Nursing recommend statutory training and mandatory training should be undertaken during work time. Many healthcare providers such as NHS Trusts and private employers may require healthcare staff to attend statutory mandatory training or annual mandatory training updates on their days off and then give them the equivalent time off as compensation. Mandatory training and statutory training should also be provided for NHS bank staff and healthcare workers (nurses, doctors and healthcare support workers) who work night shifts. All agency workers, agency nurses, locum social workers, locum ahps and locum doctors should complete candidate mandatory training as specified for the locum industry. Many NHS professionals and locum workers complete initial induction mandatory training, then annual online mandatory training updates and classroom refresher training for practical mandatory training subjects such as basic life support (bls) training, cardiopulmonary resuscitation (cpr) training, automated external defibrillator (aed) training, manual handling training and people moving and handling classroom mandatory training.

The working time regulations consider any training, including statutory and mandatory training as 'working time', as well as the Agency Worker Regulations (AWR). What are the mandatory training update requirements for nursing staff?

After completing initial mandatory induction training and statutory training, nurses and other healthcare staff (including healthcare assistants, allied health professionals and doctors) should attend mandatory training annual updates (sometimes called mandatory training refresher courses). Annual mandatory training refresher courses are dependent on individual job roles of each professional group and specific organisations preferences and requirements. Does the NMC provide mandatory training requirements for nurses?

Although all practicing nurses should be registered with the Nursing and Midwifery Council (NMC), the NMC does not set specific mandatory training requirements for nurses. There is however a requirement by the NMC that all registered nurses and midwives should undertake the mandatory training that is relevant to their nursing role to ensure that they deliver competent services and safe patient care. The NMC also requires registered nurses and midwives to cooperate with their employers by following locally set protocols, policies and procedures . 

What are the mandatory training obligations for NHS and private healthcare providers?

There are various statutory and mandatory training frameworks that provide guidance on how employers should be deliver mandatory training. For example, NHS Trusts are required to meet the standards for better health, NHS litigation authority risk management standards and the Care Quality Commission (CQC) inspection criteria. As such, most NHS Trusts set their mandatory training standards to meet CQC requirements. Other considerations for mandatory training frameworks include the following:

  • the risks within the working environment
  • the specific needs of the workforce
  • the expectaations and standards set by insurance providers 
  • local and national governance and legal frameworks in place
  • country-specific (or UK-wide) national requirements
  • equality and diversity considerations 

All employers have a responsibility under the Equality Act 2010 to ensure that their training policies and practices do not disadvantage or negatively impact protected groups. Example of such practices may include employers arranging mandatory training sessions/updates on certain days of the week that might prevent employees with a religious belief or faith from attending.

What are the equality and diversity considerations for mandatory training?

The Equality Act 2010 places a responsibility on employers to eliminate discrimination, harassment and victimisation and promote equal opportunities. This means employers should consider those protected under the Act when designing and delivering statutory and mandatory training. The employer should consider what adjustments can be made for staff with a disability. This this could be to ensure the times and locations and delivery of the training is suitable and accessible. The employer should remove any physical barriers, or provide extra equipment or aids where required.

What are the mandatory training requirements for agency and bank workers?

Your contract with the temporary work agency should outline your right to access essential (often called mandatory) training to ensure you work in a safe manner. Common training areas covered should include:

  • data protection
  • health and safety at work
  • control of substances hazardous to health (COSHH)

  • infection control
  • manual handling
  • lone working
  • safeguarding vulnerable adults
